AIA and ConsensusDOCS Contract Documents: Comparison and Contrast

Training Provided by Lorman Education Services nHardly a business day goes by in the construction industry when the parties involved in the construction contracting process encounter standard form contract documents. Two of the principal sources of such standard form construction contract documents have both recently issued the 2007 editions of their respective families of contract forms. The long established family of documents published by the American Institute of Architects has been substantially revised. The new family on the block, the ConsensusDOCS, represents an effort by a broad industry coalition of construction industry interests (owner, contractor, subcontractor, and insurance and surety interests) to develop by a consensus process and comprehensive set of standard forms. These standard forms can and likely will be encountered frequently in the construction contracting process, either in relatively clean or in substantially modified forms, and even where the forms themselves are not conspicuously used, many of their concepts and even their explicit language will show up in a variety of proprietary construction contracting forms and practices. Thus, as the "battle of the contract forms" has now begun and the construction industry begins the debate as to the relative merits of these two families of documents, this teleconference will assist you in your understanding and application of the two families of documents - where they are similar and where they are different, sometimes materially so. It will highlight areas of concern and of potential modification of the various contract forms as well as aid in the selection of appropriate standard form contract documents. n nThis teleconference will provide insights and information that will be of significant value to anyone involved in the construction contracting processes, including those involved in contract formation and negotiation, contract administration, payment application and administration, change order and claims processing, and dispute resolution. n nLearning Objectives: n- You will be able to describe what is new and different from the prior 1997 AIA document editions. n- You will be able to identify why and how the 2007 ConsensusDOCS were developed. n- You will be able to compare the 2007 AIA Documents and the 2007 ConsensusDOCS. n- You will be able to compare the electronic forms and formatting and options regarding useability of each family of documents.
