Employee Retaliation: Supreme Court Update

nThe mere mention of retaliation in the workplace today sends waves of concern throughout an employer's organization. Most recent court decisions recognize retaliation claims in nearly all areas of employment law and find adverse actions in a variety of circumstances, beyond demotion and termination, for purposes of upholding such claims. Most significantly, the U.S. Supreme Court recently determined in CBOCS West, Inc. v. Humphries, 128 S.Ct. 1951 (2008) that employees can bring retaliation claims under Section 1981, a post-Civil War era race discrimination act, even though the law does not expressly refer to retaliation. Moreover, the CBOCS West decision recognizes a retaliation claim brought by an individual of any race, who suffers an adverse action as a result of attempting to help another employee who has been directly subjected to racial bias. Additionally, the current presidential administration has expressed a heightened interest in workplace fairness issues which not only is likely to lead to more employee-friendly legislation, but also, to greater public scrutiny of employer actions in general.
