Many condominium developers and home builders who are subject to the federal Interstate Land Sales Full Disclosure Act do not understand how to comply, or perhaps worse, they think they're in compliance when they're not. These developers do not understand either how to draft unit purchase agreements to comply with the completed home exemption or when circumstances of their program would indicate consideration of registration. This teleconference will help you to understand firsthand how to methodically analyze your projects, whether currently under construction, on the drawing boards, in sales or post sales, and match the facts, circumstances and needs of the project with the compliance profile best suited for ILSA requirements. The teleconference will also explain the substance and details of contract compliance with ILSA exemption standards and provide overview and detail on key exemptions and registration. What's more, Mr. Chasnow will cover defense against claims of ILSA violation made by purchasers of condo units or homes to increase the developer's chances of successful deflection of allegations of ILSA violation. Failing to have properly drafted contracts for condo units or homes, or a HUD registration, is a common error of developers and exposes them to individual rescission actions and sometimes class action suits on a broad scale. Finally, the issue of piggyback exemptions will be explored and discussed.
