nEffective employee waivers establish employee expectations and protect employers from liability for employment-related claims such as discrimination, harassment and retaliation, as well as contract claims and tort claims such as defamation and invasion of privacy. Pre-employment waivers put employees on notice of employment screens such as background checks and drug testing. During employment, employee waivers define employee expectations of privacy in the workplace and limit company liability for employee activities. After employment has ended, particularly in the context of group layoffs, effective and legally compliant waivers are critical in protecting employers from claims. This teleconference will address how to prepare and implement effective waivers in all stages of the employment relationship, with a focus on waivers of employee claims in the context of separations and reductions in force.
