nIn the last year, new federal rules under the Fair Credit Reporting Act and Fair and Accurate Credit Transactions Act have become effective. These rules restrict cross-marketing by financial institutions and other companies; impose new requirements on companies that use credit reports; and require lenders and others to establish new fraud prevention programs. In addition, a spate of federal court decisions interpreting the increasingly complex provisions of the FCRA and FACT Act has been issued.

nThese new rules and court decisions present challenges and opportunities for lenders, insurers, securities firms and other financial institutions.
