BenefitsYou have all seen in the news media reports of companies settling employment-related class actions for many millions of dollars. The horror of class actions is that a small claim among a few employees can mushroom into a huge claim worth millions of dollars once some ferocious plaintiff's lawyers get their teeth into it and add hundreds of additional claims through the simple process of becoming a class action.
Not only do you have to pay a huge settlement to a large number of class members, but attorney's fees are added on top of that. A classic example of this concerns overtime payments. Employees may show up early or stay a few minutes late, but the employer is responsible for paying overtime for this work, even though it was never authorized and the company may even have a policy against it. Once a plaintiff's lawyer gets hold of the case, the company may have to pay for all that back-pay at an overtime rate, plus attorney's fees.
Or, as in one case, the company had unpaid breaks, but no one was required to time out on the clock. Therefore, it looked like these employees were not paid for working through breaks and it cost the company many millions of dollars. So - don't bet the company - follow the rules strictly and avoid voracious plaintiff's attorneys.
