Motor Vehicle Searches: Impact of the Arizona v. Gant Decision

Gant, 556 U.S. ___ (2009) changed the way police must handle the search of an automobile incident to an arrest. For nearly as long as the automobile has existed, the Supreme Court has found an exception to the general Fourth Amendment warrant requirement for the search of cars if the search is based upon probable cause. See Carroll v. United States, 267 U.S. 132 (1925). More recently, the court has created constitutional rules that allow police to search motor vehicles even without probable cause in certain situations. One of the most significant of these rules allows police to search a vehicle without probable cause incident to a lawful arrest. Established in New York v. Belton, 453 U.S. 454 (1981), police were permitted to search the interior of the vehicle after arresting a suspect to protect officer safety and prevent the destruction of evidence. After years of a broad interpretation of Belton by both Circuit Courts of Appeals and the Supreme Court itself in Thorton v. United States, 541 U.S. 615 (2004), that allowed police to conduct a search even after a suspect is in custody and no longer a threat to officer safety, the Supreme Court has significantly limited police authority to conduct searches incident to an arrest in Gant. This teleconference will include an overview of the current state of the law impacting motor vehicle searches, explain how the Gant decision will impact the ability of police to search automobiles, and discuss how police departments should train officers to comply with the decision.
