President Obama signed the
Credit Card
Accountability,
Responsibility and
Disclosure Act of 2009 to regulate several aspects of the credit card industry. This is one of the most sweeping changes to hit the industry for quite some time.
This new legislation amends the Truth in Lending Act, the Fair Credit Reporting Act and the Federal Trade Commission Act, and places a number of restrictions on the credit card industry and consumer reporting agencies. Some notable changes in the bill are when and how a card company can raise an individual's interest rate, who can receive a solicitation for a credit card, how payments are applied to credit card balances and how much time cardholders are given to pay their bill.
Card issuers will have to speed up implementation as certain provisions of the bill will go into effect in 90 days and other provisions will go into effect nine months from now. The Act places special emphasis on regulators to be accountable for enforcement of the law and contains increased penalties for card issuers that violate these new restrictions.
