Twitter has exploded in popularity over the last few years. According to an
October 2008 survey, 51 percent of employees accessed social networks at least once per day at work; many of them did so for an hour or more per week. Despite these numbers and the risks inherent in employees using social networking tools, such as harassment, dissemination of trade secret information and lost productivity, employers have been slow to adopt and disseminate policies for appropriate usage of these web sites. Thus, employees are left to guess at what kind of conduct is permissible online; and, without effective policies in place, employers may be opening themselves to liability on a host of issues. It is therefore crucial for employers to understand their rights and obligations when dealing with employees who present such problems.
